• No smoking, eating or drinking.
• No use of electrical devices including cell phones, flashlights or laser pointers.
• No photography or videotaping.
• No illuminated objects.
• No running, pushing or shoving.
• No touching of props or performers.
• No sharp objects, weapons or firearms.
You will not be admitted if you appear intoxicated or under the influence of drugs.
If you violate any of these rules you may be asked to leave the park without a refund.
Disclaimer & Assumption of Risk
The attractions of Bayville Scream Park are intense theatrical experiences. You will experience loud noises, bright lights, dark spaces, strobe lights and fog machines as well as damp or wet conditions and a physically demanding environment with possible uneven terrain.
You should not enter if you are pregnant, have problems with claustrophobia, have heart, back or neck conditions, are prone to seizures, have respiratory problems or any other physical or mental limitation that will impair your ability to experience these attractions.
Visitors to Bayville Scream Park understand that there is an inherent risk in entering the haunted attractions. In consideration and acceptance of admission to Bayville Scream Park visitors agree to release the operator, its parent company, affiliates, officers, directors, employees and land owner from any liability for harm, injury, death or expense that may arise directly or indirectly from visiting Bayville Scream Park.

If you are exhibiting any COVID-19-related symptoms, you should not enter or remain on the property.
By purchasing one or more tickets Online through this Web site, you are automatically agreeing to be unconditionally bound by these Terms & Conditions:
You agree to comply with all Park rules, heed all signs and warnings, and follow all Park instructions.
Group leaders are responsible for supervision of their group members and must be familiar with Park rules and ride-height requirements.
Parents/Guardians are responsible at all times for supervision of minors.
Proper attire required.
No refunds, rain checks or exchanges whatsoever, including for loss or theft.
Not for resale. Valid for admission to Park shown on front of ticket per noted specifications.
Days/hours of Park and ride operation subject to change without notice. Park makes no representations or guarantees about possible wait-times for attractions.
Admission to certain rides, shows, attractions and special events may require an additional charge or be subject to height / age or other safety restrictions at Parkís discretion.
Park may deny admission or expel bearer without refund for any of the following: Illegal, disorderly, inappropriate or offensive conduct, clothing, markings or language; being drunk or drug-influenced; possession of a firearm, hazardous material, or other weapon-like device; fraudulent use, alteration or reproduction of ticket or obtaining ticket from unauthorized source; violating Park rules (verbal, posted, printed) or attendant instructions; anything the Park in its sole discretion deems a threat to the welfare, safety or enjoyment of Park, its guests or staff.
Bearer grants an unrestricted, perpetual license to Park to use the bearer’s name, photograph, voice or likeness in any promotional materials, in any media, without notice, payment or consideration, and without regard to alterations.
BEARER FULLY AND FOREVER RELEASES PARK (including all affiliates, employees, officers and directors) FROM ANY AND ALL CLAIMS, CAUSES OF ACTION AND LIABILITIES, OF ANY KIND OR NATURE WHATSOEVER, INCLUDING PERSONAL INJURIES OR PROPERTY THEFT, IN RELATION TO THE PARK. BEARER ACKNOWLEDGES CERTAIN INEVITABLE HAZARDS ASSOCIATION WITH PARK’S OPERATIONS AND ASSUMES THE RISK OF ALL PARK ACTIVITIES.

SMS Giveaway Contest Terms
Terms and Conditions for Bayville Scream Park’s SMS Giveaway Contest as of Aug 16, 2024.
Eligibility: The giveaway contest is open to participants who meet the following criteria:
Reside in the USA
Are 18 years of age or older
Are not employees of Bayville Scream Park or their affiliates, nor members of their immediate families or households.
Entry: To enter, participants must follow the instructions outlined in the SMS popup campaign on our website. Entry requirements include signing up for email and SMS, and retaining the subscription at least through October 27th 2024. Entries complete, accurate, or submitted after the deadline will be disqualified.
Duration: The giveaway contest starts on August 16th 2024 and ends on October 27th 2024 at 12am PST. Only entries submitted before the deadline will be considered.
Prize: The winner will receive 8 Speed Pass Admission Tickets with Bar Passes to Bayville Scream Park, valid any day through November 9th 2024. As defined in the terms, the prize is non-transferable, and there will be no cash alternatives to it. Bayville Scream Park reserves the right to substitute the prize with a product or service of equal value.
Winner Selection: The winner will be selected randomly from all eligible entries by the deadline. The winner will be notified by SMS within 1 day after the deadline. If the winner does not respond within 24 hours, another winner will be selected.
Liability: Bayville Scream Park is not responsible for any injury, loss, or damage to participants or their property related to their participation in the giveaway contest. Participants agree to release and hold harmless Bayville Scream Park and their affiliates from any liability, injury, loss, or damage resulting from participation in the giveaway contest or acceptance, use, or misuse of the prize.
Governing Law: The giveaway contest and these terms and conditions are governed by and construed per the laws of the USA.
Dispute Resolution: Any dispute arising from or related to the giveaway contest or these terms and conditions will be resolved through binding arbitration per the rules of an Arbitration Service chosen by Bayville Scream Park. The arbitration will occur on Long Island in New York, and the arbitrator’s decision will be final and binding.
Modification: Bayville Scream Park reserves the right to modify, suspend, or terminate the giveaway contest without notice. Sacramento Scream Park also reserves the right to modify these terms and conditions without notice.
Video & Photography
Bayville Scream Park may take and use images & video of all guests. Bayville Scream Park at all times reserves the right to videotape patrons, and take still images, and to utilize those images and videos for any reason, including marketing, advertising, promotion, on social media, live streaming on the Internet, for safety and security, for documentation as evidence in a legal or criminal matter or other investigation, for news reporting, and otherwise in an unrestricted manner for legitimate purposes. All property ownership of such materials, and copyright in and to all such materials, shall belong exclusively to Bayville Scream Park in perpetuity, without any compensation or other consideration to any guest or other person in, on or around the Bayville Scream Park property, or parking lot.
Bayville Scream Park Messaging Terms and Conditions
You agree to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages (e.g., cart reminders) from Bayville Scream Park, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Msg & Data rates may apply.
Message frequency will vary. Bayville Scream Park reserves the right to alter the frequency of messages sent at any time, increasing or decreasing the total number of messages. Dispute Resolution
General
To resolve disputes between you and Bayville Scream Park in the most expedient and cost-effective manner, both parties agree that any dispute arising from or related to these messaging terms and conditions (“Messaging Terms”) or your receipt of text messages from Bayville Scream Park or its service providers will be resolved through binding arbitration. Arbitration is less formal than a court lawsuit, using a neutral arbitrator instead of a judge or jury, with potentially more limited discovery. Arbitrators may award the same damages and relief as courts. By agreeing to these Messaging Terms, you and Bayville Scream Park waive the right to a jury trial or class action. The Federal Arbitration Act governs this agreement.
Exceptions
This arbitration agreement does not prevent either party from:
- Filing individual claims in small claims court.
- Pursuing enforcement actions through applicable agencies.
- Seeking injunctive relief from a court of competent jurisdiction.
- Filing claims in court for intellectual property infringement.
Arbitration Process
Arbitration between you and Bayville Scream Park will follow the rules of the American Arbitration Association (AAA) under its Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer Related Disputes (“AAA Rules”), as modified by these Messaging Terms. Details are available at www.adr.org or by calling 1-800-778-7879. The arbitrator will have exclusive authority to resolve disputes regarding these terms.
Notice & Process
To initiate arbitration, the party seeking arbitration must send a written Notice of Dispute to the other party. Notices to Bayville Scream Park should be addressed to: 8 Bayville Ave, Bayville NY 11709. The Notice must describe the claim and the relief sought. If the dispute cannot be resolved within 30 days of receiving the Notice, either party may commence arbitration.
Fees
Bayville Scream Park will reimburse filing fees for claims under $15,000 unless deemed frivolous or improper under Rule 11(b) of the Federal Rules of Civil Procedure. Arbitration outcomes and information exchanged remain confidential.
No Class Actions
Both parties agree only to bring claims in individual capacities, not as part of a class or collective action.
Modifications
Future changes to this arbitration agreement will not affect previous disputes unless you reject the modification by providing written notice within 30 days of the change.
Enforceability
If any part of this arbitration agreement is deemed unenforceable, the remaining terms will remain in effect.
